These Terms of Service (“Terms”) are a contract between you and Web42 (“Web42”, “we”, “us”) governing your use of the Web42 website builder, the agent that powers it, and any related services such as domain registration. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
You must be at least 18 years old to use Web42. By creating an account you confirm that you are 18 or older and able to enter into a binding contract in the country where you live.
You are responsible for the security of your account credentials and for everything that happens under your account. Keep your password private, do not share your account, and notify us promptly at the contact address below if you suspect unauthorised access. We may suspend or close accounts where there is evidence of abuse, fraud, or breach of these Terms.
When using Web42 — including the agent, the wizard, file uploads, contact-form messages, and any sites you publish through us — you agree that you will not:
We may remove content or suspend accounts that breach this section without notice where the breach is serious or ongoing.
Web42 is AI-powered. The agent may produce inaccurate or misleading content. You are responsible for reviewing generated copy, code and design before publishing it to the world. Do not publish AI-generated claims about real people, real prices, real regulated products (medical, legal, financial) or other fact-sensitive material without checking and editing it yourself.
You own the websites you build with Web42. Specifically:
The Web42 platform itself — the agent loop, the wizard, the dashboard, our trade marks and our source code — remains our property. These Terms do not transfer any rights in the platform to you.
Some features (collectively “Web+”) require a paid subscription that renews monthly or annually as selected. By subscribing you authorise us, through Stripe, to charge the applicable fee on each renewal date until you cancel. Prices are shown in GBP, USD or EUR depending on your country selection and are exclusive of VAT or sales tax unless stated otherwise.
Some Web42 features — including agent runs, restyles and structured-content updates — are paid for from a prepaid credit balance which you top up by card through Stripe. Credit is denominated and measured internally in microcents (1 GBP = 100,000,000 microcents) and displayed to you in GBP, USD or EUR using our prevailing conversion rate.
All credit purchases are final and non-refundable. Once you have completed a top-up, the amount you paid is not refundable, regardless of whether the credit has been used, partially used, or has expired. This applies to all credit on your account, however it was acquired (purchased top-ups, promotional grants or any other source).
Credit expires 60 days after purchase unless your account meets the Web+ active condition described in this section. Expiry is tracked per top-up. When credit expires it is removed from your balance and forfeited; expired credit cannot be restored, transferred, refunded or exchanged. We are under no obligation to make exceptions, including in cases of inactivity, forgotten accounts, or claims that the credit was not used because of personal circumstances.
Web+ pauses credit expiry across your whole account. While at least one of your projects has an active or paying Web+ subscription (including states Stripe treats as paying, such as “trialing”, “past_due”, and a subscription flagged for cancellation but still inside its current paid period), no credit on your account expires — including credit you purchased before the subscription started. When your last subscription ends and no other paying subscription is active on any of your projects, a fresh 60-day expiry window starts at that moment. Re-subscribing within that window pauses expiry again. The clock does not pro-rate; each cancellation resets the window to a fresh 60 days.
We will, as a courtesy, attempt to email the address on your account approximately 7 days before unused credit is due to expire. This notice is best-effort. We cannot guarantee delivery, and the absence of such an email does not extend the expiry period. It is your responsibility to keep an eye on your balance and the expiry date displayed in the dashboard.
We may, in our sole discretion, reverse a credit purchase in the case of confirmed fraud, payment-card chargeback, or our own operator error. We are under no obligation to reverse a credit purchase for any other reason.
You can cancel a Web+ subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period, so you keep access to Web+ features until then. We do not provide pro-rata refunds for partial billing periods, and we do not refund elapsed periods.
Domain registrations are non-refundable once the domain has been registered with the registry, because we incur a non-refundable fee from the registrar at the moment of registration. If a registration attempt fails before the domain is created, we will refund the full amount.
Statutory rights — including any cancellation rights under UK and EU consumer law where they apply — are not affected by this section. The non-refundable status of credit purchases is a contractual term you accept at the moment of purchase.
Domain registrations are processed through our registrar partner, Namecheap Inc., an ICANN-accredited registrar. By registering a domain you also agree to Namecheap’s Registration Agreement and to ICANN’s Registrant Rights and Responsibilities. You must provide accurate WHOIS contact data; providing false information may result in domain suspension as required by ICANN policy. We enable free WHOIS privacy on registrations where available. Domain disputes are subject to ICANN’s Uniform Domain-Name Dispute-Resolution Policy. Each project may have at most one domain attached, and a domain may only be purchased while the project has an active Web+ subscription. Renewal prices may differ from the initial registration price.
Web42 depends on third-party services including Anthropic (AI), Supabase (database and auth), Stripe (payments), Cloudflare (CDN and storage), Resend (email) and Namecheap (domains). We choose these providers carefully but we are not responsible for outages, errors or policy changes on their side. Where their terms apply to your use of those services they are linked from our Privacy Policy.
Web42 is provided on an “as is” and “as available” basis. To the maximum extent permitted by law we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure against every possible attack, or that AI-generated content will be accurate, complete or fit for any particular use. You assume responsibility for choosing the service and for the results you obtain from it.
To the maximum extent permitted by law:
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded — for example liability for death or personal injury caused by negligence, or for fraud.
You will indemnify and hold harmless Web42 and its officers, employees and contractors against any claim, loss, liability, damage and reasonable legal cost arising from (a) content you publish through the service, (b) your breach of these Terms, or (c) your violation of applicable law or third-party rights.
You may stop using the service and delete your account at any time from the account settings (or by emailing us). We may suspend or terminate your account, with notice where reasonably practicable, if you breach these Terms, if continued provision exposes us or other users to material risk, or if we are required to do so by law. On termination, sections that by their nature should survive (ownership, disclaimers, limitation of liability, indemnity, governing law, dispute resolution) will continue to apply.
We may update these Terms from time to time. For material changes we will give account holders reasonable advance notice by email and / or in-product. Continued use of the service after the effective date of an updated version constitutes acceptance. If you do not accept the updated Terms, you should stop using the service and may close your account before the effective date.
These Terms are governed by the laws of England and Wales (TODO: confirm jurisdiction once the operating company is incorporated; England & Wales is the working assumption given the GBP base currency). The courts of England and Wales have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the service, except that consumers resident in another EU member state may instead bring proceedings in the courts of their country of residence to the extent required by law.
Before issuing court proceedings we ask you to first email us at the address below so we can attempt to resolve the matter directly. We will respond within a reasonable time and act in good faith.
